1. Agreement
By accessing or using begen.space ("the Platform"), you agree to these Terms of Service. If you do not agree, do not use the Platform. We may update these terms at any time. Continued use after changes constitutes acceptance.
2. Eligibility
You must be at least 16 years old to create an account. By using the Platform, you represent that you meet this requirement and that the information you provide is accurate.
3. Accounts
You are responsible for maintaining the security of your account credentials. You may not share your account or use another person's account. We reserve the right to suspend or terminate accounts that violate these terms.
4. Your Content
You retain all ownership rights to content you upload ("Your Content"). By uploading content to the Platform, you grant begen.space a non-exclusive, worldwide, royalty-free license to display, distribute, and promote Your Content in connection with operating the Platform. This license ends when you delete Your Content from the Platform.
You represent that you have the right to upload Your Content and that it does not infringe on any third party's intellectual property or other rights.
5. AI-Generated Content
begen.space is a portfolio platform for generative AI creators. We welcome content created with AI tools. You are responsible for ensuring your AI-generated content does not violate the terms of the AI tools you used to create it, and that it complies with our Community Guidelines.
We do not use Your Content to train AI models. Your work is yours.
6. AI Training Opt-Out
We respect creators' wishes regarding AI training. We do not license, sell, or provide user content for the purpose of training generative AI models. Third-party crawlers are blocked via robots.txt where technically feasible.
7. Prohibited Conduct
You may not:
- Upload content that is illegal, harmful, threatening, abusive, or hateful
- Upload content depicting minors in inappropriate contexts
- Upload deepfakes of real people without their consent
- Impersonate another person or misrepresent your identity
- Use the Platform to spam, harass, or distribute malware
- Circumvent any security measures or access restrictions
- Scrape, crawl, or collect data from the Platform without permission
- Resell or redistribute the Platform's services
8. Subscriptions and Payments
The Platform offers free and paid subscription tiers. Paid subscriptions are processed through Stripe. By subscribing, you agree to Stripe's terms of service. Subscription fees are billed monthly and are non-refundable except where required by law.
We may change subscription pricing with 30 days' notice. If you downgrade from a paid tier, your content is not deleted -- uploads beyond free-tier limits are hidden until you upgrade again.
9. Termination
You may delete your account at any time from your settings. We may suspend or terminate your account for violations of these terms. Upon termination, your right to use the Platform ceases immediately. We will delete your stored content within 30 days of account deletion.
10. Intellectual Property
The Platform's design, code, branding, and original content are owned by begen.space. You may not copy, modify, or distribute any part of the Platform without written permission.
11. Disclaimers
The Platform is provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free service. We are not liable for any loss of data, revenue, or damages arising from your use of the Platform.
12. Limitation of Liability
To the maximum extent permitted by law, begen.space's total liability to you for any claims arising from your use of the Platform shall not exceed the amount you paid to us in the 12 months preceding the claim, or EUR 100, whichever is greater.
13. Governing Law
These terms are governed by the laws of the European Union and the member state in which begen.space operates. Disputes shall be resolved in the competent courts of that jurisdiction. Nothing in these terms limits your rights as a consumer under applicable EU law.
